A federal magistrate in Yuma has allowed a U.S. Border Patrol agent to be freed without bond until his trial on marijuana smuggling charges.
Agent Michael Atondo was arrested earlier this month after two other agents found 745 pounds of marijuana in his Border Patrol truck. The truck was backed up to the border fence about 40 miles east of Yuma.
Assistant U.S. Attorney Louis Uhl tried to convince Magistrate Jay Irwin at Monday's hearing that Atondo was a flight risk. The Yuma Sun says Uhl said Atondo appeared to be a mole who infiltrated the Border Patrol to smuggle drugs.
Yuma attorney John Minore says his client is only accused of a crime and he doesn't know if "he strayed to the dark side."
